General terms and conditions of business

Terms and Conditions (English) – Cozy Homes (Version for convenience) Important note: This English version is provided for convenience only. In case of discrepancies, the German version shall prevail.

2. Scope 2.1 These Terms and Conditions apply to all contracts for the temporary rental of holiday accommodation offered by Cozy Homes for short-term lodging (not for residential purposes) concluded via https://cozyhomes.myweb.smoobu.com. 2.2 Any deviating terms of the Guest shall not apply unless expressly agreed by the Host in text form.

3. Booking process / Conclusion of contract 3.1 The presentation of accommodation and prices on the website does not constitute a binding offer, but an invitation to book. 3.2 By completing the booking process, the Guest submits a binding offer. The contract is concluded by (a) booking confirmation in text form (e.g. email) or (b) provision of the booking confirmation within the booking system. 3.3 The Guest must provide correct booking details (dates, number of guests, contact details). 3.4 Bookings are only permitted for persons of legal age.

4. Prices / Services / Additional costs 4.1 The prices displayed at the time of booking apply. Unless stated otherwise, prices include statutory VAT. 4.2 The following services are included: bed linen, towels, final cleaning, Wi-Fi, electricity/water/heating. 4.3 Any additional costs are shown during the booking process, e.g. local tourist tax/guest contribution, optional services such as baby cot, interim cleaning. 4.4 Any applicable tourist tax/guest contribution is charged separately and remitted in accordance with local regulations. Registration data entry and payment are handled via STRtax. All process details are provided during booking (including a link redirecting to STRtax). Data entered in STRtax is used solely to comply with legal registration obligations and to process the local guest contribution.

5. Payment / Due date 5.1 Unless agreed otherwise, the total price is due before arrival. 5.2 Payment methods: bank transfer / credit card / Stripe. 5.3 Timely payment is determined by receipt of funds by the Host. 5.4 In case of late payment, the Host may withdraw from the contract after a reminder and charge cancellation fees in accordance with clause 6.

6. Cancellation by the Guest 6.1 The Guest may cancel the booking at any time before the start of stay. Cancellation must be made in text form (e.g. email). The date of receipt by the Host is decisive. 6.2 In the event of cancellation, the Host is entitled to reasonable compensation. Saved expenses and any re-letting shall be credited. Cancellation policy: up to 14 days before arrival: free of charge from 13 days before arrival (incl. no-show): 100% of the total price Note: If the Host re-lets the accommodation in whole or in part for the cancelled period, corresponding revenue will be credited. 6.3 The Guest may provide evidence that no damage or substantially less damage occurred. 6.4 The Host recommends taking out travel cancellation insurance.

7. No right of withdrawal For accommodation services provided on a specific date or during a specific period, there is no statutory right of withdrawal.

8. Arrival / Departure / Access 8.1 Check-in from 3:00 pm · Check-out by 11:00 am (different times only by agreement). 8.2 Access is provided via a smart lock (Nuki). Access data must be kept confidential and must not be shared with unauthorised third parties. 8.3 In case of loss of keys/access devices/underground parking remote, the Guest bears the replacement costs and, where necessary, the costs of changes to locking/access systems.

9. Use of the accommodation / House rules 9.1 The accommodation may only be used by the agreed number of guests. Over-occupancy is prohibited. 9.2 Parties/events: prohibited. 9.3 Smoking: prohibited inside the accommodation; permitted on the balcony when using the provided ashtray. 9.4 Pets: not allowed. In case of non-compliance, the Guest bears cleaning costs and compensation for any damage incurred. 9.5 Quiet hours: 10:00 pm–8:00 am. Consideration for neighbours and the building community must be observed. 9.6 The Guest undertakes to treat the accommodation and inventory with care and to comply with the attached house rules. 9.7 Subletting or transferring the accommodation to third parties is prohibited without the Host’s consent.

10. Security deposit 10.1 The Host may require a deposit, in particular for long-term stays. 10.2 The deposit secures all claims (e.g. damages, missing items, additional cleaning). 10.3 The deposit will be refunded within 7 days after departure and inspection, provided no claims exist.

11. Defects / Notice obligation 11.1 Defects must be reported without undue delay (in text form or by phone) so the Host can remedy them. 11.2 If the Guest fails to report defects, claims for reduction or damages may be excluded or reduced insofar as the Host could not remedy the defect due to missing notice.

12. Host liability 12.1 The Host is liable without limitation in cases of intent and gross negligence, for injury to life, body or health, and under mandatory statutory provisions. 12.2 In cases of slight negligence of essential contractual duties, liability is limited to the foreseeable, typical damage. 12.3 Otherwise, liability is excluded to the extent legally permissible. 12.4 The Host assumes no custody obligations for items brought in by the Guest, except in cases of intent or gross negligence.

13. Guest liability 13.1 The Guest is liable under statutory provisions for damages caused by the Guest, co-travellers or visitors. 13.2 Additional costs resulting from breach of contract (e.g. special cleaning, smoke damage, loss of keys) shall be reimbursed by the Guest.

14. Force majeure / Unavailability 14.1 In cases of force majeure (e.g. natural disasters, official orders) that substantially hinder or make performance impossible, both parties are released from performance obligations for the duration of the disruption. 14.2 Payments made for services not rendered will be refunded; further claims are excluded to the extent legally permissible.

15. Data protection Personal data is processed in accordance with the privacy policy at https://cozyhomes.myweb.smoobu.com/new-page70a58969.

16. Consumer dispute resolution The Host is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

17. Final provisions 17.1 German law shall apply. For consumers, this applies only insofar as mandatory consumer protection provisions of the state of habitual residence are not deprived. 17.2 Should any provision be invalid, the remaining provisions shall remain unaffected. 17.3 If the Guest is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction (to the extent legally permissible) shall be Cologne (Köln), Germany. Otherwise, the statutory places of jurisdiction apply.
